The drug laws we looked at regulate substances: what you may possess, make, sell or import. None of them lists reagent test kits like Dope or Nope. Possessing most of the drugs you would test is a different matter, and in most countries an offence. The notes below are short summaries, checked on 10 October 2026, with a link to the source. They are no legal advice, and laws change.
Netherlands
The Opium Act (Opiumwet) prohibits possessing, selling and producing the substances on its List I (hard drugs) and List II (soft drugs) (wetten.overheid.nl). 4-FA has been on the Opium Act since 25 May 2017 (Drugs Infolijn). Having drugs tested is possible at the DIMS testing locations (drugs-test.nl).
Germany
Under § 29 of the Narcotics Act (BtMG), possessing narcotics without written permission is punishable with up to five years in prison or a fine (§ 29 BtMG). § 10b BtMG lets the federal states permit drug checking model projects (§ 10b BtMG). Cannabis follows its own law: adults may possess up to 25 grams for personal use under § 3 of the Consumer Cannabis Act (§ 3 KCanG).
France
Illicit use of a substance classified as a narcotic is punishable with one year in prison and a fine of 3,750 euros. For simple use of cannabis, cocaine or ecstasy by an adult, the police can instead issue a fixed fine (amende forfaitaire délictuelle) of 200 euros, with a reduction for quick payment (Drogues Info Service).
Spain
Using or possessing illegal drugs in public places, streets, public establishments or public transport is a serious administrative offence under article 36.16 of the Organic Law 4/2015 on the protection of public safety, even when the drugs are not meant for trafficking. Serious offences carry fines from 601 to 30,000 euros (BOE, Ley Orgánica 4/2015).
United Kingdom
You can get a fine or a prison sentence for taking, carrying, making or supplying drugs. Penalties depend on the class of the drug, the amount, and on whether you also deal or produce it (GOV.UK).
What this means for testing
A test kit tells you something about a sample; it does not change the legal status of that sample. Testing a substance does not make possessing it legal anywhere. Several countries do offer official drug checking, where you can hand in a sample under conditions set by the service: DIMS in the Netherlands, model projects in German states such as Berlin, and Energy Control in Spain.
